First Offense DUI A Team Backed By 100 Years of Experience

First-Offense DUI Lawyer in Newport Beach

A Former Orange County Prosecutor on Your Side

A first DUI arrest sets two legal processes in motion at once: a criminal case at the Harbor Justice Center and a DMV administrative proceeding that starts the moment you’re taken into custody. You have 10 days from your arrest to request a DMV hearing or your license suspension becomes automatic. The criminal case moves on its own timeline, but both tracks demand attention from the start. At Corrigan Welbourn Stokke, APLC, we handle both.

T. Edward Welbourn, our lead DUI attorney, spent years as an Orange County Deputy District Attorney before crossing to the defense side. He knows how the Orange County DA’s office builds DUI cases and what it takes to challenge them. Every client also draws on more than 100 years of combined practice experience across our three founding attorneys through a collaborative approach that puts the full weight of the firm behind each case.

A first DUI arrest doesn’t have to define your future. Call (949) 251-0330 for a free consultation. We’re available 24/7, including overnight, and we’re ready to help you understand your options right away.

What a First DUI Conviction Can Cost You

Under California Vehicle Code Section 23152, a first DUI is typically charged as a misdemeanor. The courtroom penalties alone are serious, but the full financial and personal toll runs much deeper than most first-time defendants expect.

Potential penalties for a first-offense DUI in California include:

  • Fines: Base fines up to $1,000, with total costs routinely exceeding $2,000 to $2,500 after mandatory court assessments
  • License suspension: Up to 4 months through the DMV, separate from any court-ordered suspension
  • Probation: Informal probation of 3 to 5 years
  • DUI education program: 3, 6, or 9 months depending on your blood alcohol concentration at the time of arrest
  • Jail exposure: Up to 6 months in county jail, though first-time, non-aggravated cases often avoid this
  • Ignition interlock device: Possible mandatory installation on your vehicle

Aggravating factors can increase every one of these penalties. A blood alcohol concentration of 0.15% or higher, a minor in the vehicle, an accident involving injury, or excessive speed can push a first offense into much harsher territory. A first DUI conviction also stays on your criminal record permanently and counts as a prior offense for 10 years if you ever face another DUI charge.

Why Newport Beach Defendants Choose Corrigan Welbourn Stokke, APLC for First DUI Defense

Ed Welbourn’s background as a former Orange County Deputy District Attorney gives our DUI defense a dimension most firms can’t offer.
